Introduction

BizTek Recruitment Limited (BizTek) is an international recruitment consultancy and agency, providing permanent and contract recruitment services.

 BizTek is committed to protecting the personal information of our employees, candidates, clients, suppliers, users of our website and personal data of other individuals given to us by a third party. 

 BizTek processes personal information as a Data Controller and this privacy notice explains how we protect and use that personal data.

 

 What Data is collected by us?

BizTek may collect candidate data, client data, supplier data, employee data, website user's data, emergency contact data, referee data and data received from others such as referees.

Candidates (including potential employees)

To provide employment opportunities, services and/or information, BizTek will collect data including (but not limited to), your name and contact details plus other relevant information from your CV. This may include sensitive personal information such as nationality, passport details, and employment visa details and where appropriate and in accordance with local laws and requirements, we may collect information related to diversity, health or details of any criminal convictions. BizTek may also collect referee data such as name and contact details and data subsequently provided by such referees.

 Clients

To provide services in relation to finding candidates for your organisation and ensuring the contractual agreement between us can be implemented smoothly, BizTek will collect contact details such as names, telephone numbers and email addresses, relating to you and individuals within your organisation. BizTek may also keep records of our conversations, meetings, registered jobs and placements, to fulfil our contractual obligations and provide the best service we can to your organisation.

 Suppliers

To maintain contractual relationships between us, BizTek will collect data from our contacts within your organisation, such as names, telephone numbers and email addresses and if applicable banking details regarding payments we make to your organisation.

 Employees

To set up employment contracts, and maintain obligations in relation to these, BizTek will collect personal data including (but not limited to), name and contact details, emergency contact details plus other relevant information on your CV. This may include sensitive personal information such as nationality and employment visa details and where appropriate and in accordance with local laws and requirements, we may collect information related to diversity, health or details of any criminal convictions.

Additionally, BizTek will collect from employees, bank account data, annual leave and sickness data and from within BizTek pay and performance details to fulfil accurate remuneration payments.

 Website Users

BizTek will only collect from our website data you provide in the ‘contact us' section which includes personal data such as name and contact details plus any other information you wish to share with us.

 Emergency Contacts or Referees

For those people provided to us as emergency contacts or referees, BizTek will collect from candidates or staff, personal data such as name and contact details (telephone number and/or email address).  This data will only be used by BizTek for the purpose for which it has been supplied. Emergency contact data will be used in the event of an accident or emergency affecting candidates or staff. Referee contact data will be used to confirm candidate details and qualifications to ensure an appropriate match between the candidate and the employer.

 

How do we collect your personal data?

For candidate data, we collect this directly from you or from third parties. You can provide data directly to us in several ways including via your CV, via email or telephone or however you may choose. Data provided from third parties includes any data referees provide about you or data collected from a job-board or business networking sites, online CV libraries or personal recommendations.

Where BizTek collects your data from a third party, we will inform you that we hold your personal data and send a link to this privacy notice, within a maximum of 30 days of collecting the data. You have the right to ask us to delete the data.

For client data, we collect this directly from you or from third parties such as our candidates. 

For suppliers, we collect your data from you as part of our relationship and work with you.

For website users, we collect data that you choose to share with us via the contact us section.

For employees, we collect data directly from you and from your manager or personnel services within BizTek or external payroll services and possibly from a referee where you have provided contact details to us.

For Emergency Contacts or Referees, we collect your contact details where a candidate or staff member has supplied them under emergency contacts or where they are given to us to obtain a reference from you.

 

How do we use your personal data?

Candidates (including potential employees)

The primary reason for using your data is to assess your suitability for employment or other work roles. This information allows us to tailor our services for you.

 Clients

The primary reason for using client data is to enhance the service we provide to you and tailor it to you or your company's needs.

Suppliers

The primary reason for using your data is to fulfil our contractual obligations and ensure our relationship continues in the most effective way.

Employees

Your data is used to fulfil our contractual obligation to you regarding holiday, sickness, pension and remuneration. Additionally, your data is used to continue and support the contract between us and assist in ensuring it continues to meet both your and BizTek's needs.

Website Users

Data you supply is used to assess your suitability for employment or other work roles and potentially provide a future service to you. This information allows us to tailor our services for you.

Emergency Contacts or Referees

Emergency contact data will be used to inform others in the event of an accident or emergency affecting candidates or staff.

Referee contact data will be used to confirm candidate details and qualifications to ensure an appropriate match between the candidate and the employer.

 

Our Lawful basis for processing your information

1.   BizTek processes your information on the basis of legitimate interests in the following circumstances:

  • Emergency contact details. It is not appropriate to obtain consent from emergency contacts hence these details are considered on a legitimate interests basis.
  • Client details for the purposes of marketing. By providing similar services to those already offered by BizTek or similar organisations these details are considered on a legitimate interests basis.
  • Candidate details where we are not processing your data on pre-contract basis. For the purposes of providing recruitment services to assist you in finding appropriate work suitable for you, these details are necessary to ensure the closest match and ensure employment opportunities are tailored to you.

For client and candidate data, BizTek thinks it is reasonable to use your data in this way for our legitimate interests as an organisation providing recruitment services to you. BizTek believes this processing will be beneficial to the individual and is unlikely to cause harm as well as have a minimal privacy impact.

2.    BizTek relies on our contractual relationship under GDPR Article 6 (1) (b) contract, to process personal data to continue our relationship with you and to provide our obligations as per the contract between us or to take steps at the request of you prior to entering into a contract. Data processed includes:

  • Employee and candidate data for the purposes of BizTek employment
  • Candidates data for the purposes of pre-contract qualification, representation and submission to a client, ongoing assignment management and renewals, payment services for you
  • Client Data for the provision of recruitment services provided to you, such as but not limited to; reviews of our services, additional resourcing requirements, passing information to you from candidates in the interview process, processing offers, creating contractual documents and all aspects of performance management
  • Supplier data where necessary to maintain our relationship

3.   BizTek processes some Employee personal details to comply with our legal obligations under GDPR Article 6 (1) (c) e.g. to comply with our legal obligation to disclose salary details to HMRC. For further details please see HMRC website  www.gov.uk/topic/business-tax/paye.

 4.    BizTek may process your data, or in some cases sensitive personal data, to comply with our legal and regulatory obligations as permitted under GDPR Article 6 (1) (f). e.g. as part of a legal process regarding unlawful activity or potentially unlawful activity.

 5.    BizTek may process your personal data under GDPR Article 6 (1) (a)  Consent, where you have provided such explicit consent for BizTek to process your data outside of the European Economic area.  

6.     BizTek may process special data or criminal convictions (sensitive personal data). Under the relevant Article 6 according to who the data belongs to, (employee or candidate), as described above and in accordance with Condition Article 9(2)(b) Employment in all cases  

 

How we safeguard your personal data

BizTek takes its responsibility for your personal data seriously and takes all appropriate and reasonable steps to protect that data from unauthorised access, loss or misuse. BizTek achieves this with a variety of both technological and organisational procedures, including encryption and password protection.

How long do we keep your personal data for?

Where we have collected your data under legitimate interests we will retain your data for 3 years.

Where we have meaningful communications with you regarding a particular role(s), such as requesting representation to submit your details to a client, we will retain your personal data for 5 years, except where we are obliged by law to retain it for longer. For candidates who are unsuccessful in the client process or with regards to permanent roles, this 5-year period will commence from the closure of the role(s) they have been submitted for. For candidates who are successful in the client process for contract/temporary roles the 5-year period will commence at the end of the assignment. This period is viewed as an appropriate timeframe during which BizTek can be requested to report on submission to clients and to provide reference checks for previous temporary workers.       

 

Who do we share your personal data with?

Candidates

We primarily share your data with employers and companies looking to hire staff for the purpose of introducing candidates to them. We may also share your data with third parties to obtain references or additional information about you or where it is necessary for you to undertake technical testing. We may also share your data where required to for legal reasons; such as requests from tax authorities. We will advise you if it is necessary for us to pass your details to any such third parties.

Clients

We will share your data with candidates where it is necessary in the provision of our services to you, e.g. where we are arranging interviews for you.

Suppliers

We may provide your data to service providers and companies to whom we provide services. If you do not wish us to do this, please write to us at the contact details below.

Employees

We will provide your necessary details to our payroll services company to fulfil our contractual obligation with you e.g. pension and remuneration.

Website Users

If you provide us with personal data and ask us to process your details as a candidate, we will share your data as per other Candidates.

Emergency Contacts or Referees

We may share referee's details with our clients, or third parties processing on behalf of clients, to fulfil our obligations with our clients and assure the most appropriate match between candidates and employers.

Emergency contacts are not shared with anyone.

 

How can you access, amend or request your data be deleted?

Although we already hold your personal data you still have certain rights related to it, these include:

  • The right to be informed

Our privacy notice is intended to provide this information for you and is available on our website and via links from other means of communications with you, e.g. email.

  • The right of access

As well as the information contained in our privacy notice you have the right to access the personal data we hold.  We may charge a reasonable fee to provide this data to you. 

  • The right to rectification

You have the right to have inaccurate personal data rectified or completed if it is incomplete.  

  • The right to erasure

You have the right to request that we erase all personal data related to you. 

  • The right to restrict processing

You have a right to request that we restrict the processing of your personal data. This allows you to request that we suspend such processing and only store your data, for example if you want us to establish its accuracy or verify the reason for processing it or you want us to hold it beyond our needs because you require the data to establish, exercise, or defend legal claims. 

  • The right to data portability

Your right to data portability does not extend to any processing BizTek will undertake.

  • The right to object

You have a right to object to processing based on legitimate interests e.g. direct marketing that we may undertake. We will cease direct marketing activities as soon as we receive an objection.   

  • Rights in relation to automated decision making and profiling

We will not process your data using any automated decision making or profiling.

We will attempt to deal with your request as quickly as possible and within any applicable legal timeframes. International transfers

Generally personal information which you supply to us is stored and maintained within the European Economic Area (EEA). However, BizTek works on a global platform and has international clients, enabling us to offer a wider variety of services, to do this we may be required to transfer or store your data internationally e.g.

To ensure the safety of your data, we will only transfer data outside of the European Economic Area or EEA (i.e. the Member States of the European Union, together with Norway, Iceland and Liechtenstein) where it is compliant with data protection legislation and the means of transfer provides adequate safeguards in relation to your data, for example

  • transferring your data to a country where there has been a finding of adequacy by the European Commission in respect of that country's levels of data protection via its legislation
  • Where necessary for the performance of a contract between ourselves or for pre-contractual steps taken at your request;
  • Where necessary for the performance of a contract made in your interests between BizTek and another person; or
  • Where you have consented to the data transfer;

  

Security

BizTek takes security very seriously and makes every effort to protect your information from unauthorised processing, loss or destruction. We use strict procedures and security features to do this. These features include encryption, the use of passwords, firewalls, spam and virus checkers and physical security measures.

BizTek offices are securely locked environments and wherever possible paperless. All paperwork with personal details is transient and shredded regularly.
